Box 6079 <br />Denver, CO 80206 <br />RE: Reason to Believe a Violation Exists at Golden Age #2 Mining; DRMS File No. <br />P- 2009 -002 <br />Dear Ms. Lemberg, <br />On July 1, 2014, the Division of Reclamation, Mining and Safety (Division) notified you in <br />writing that the Annual Fee and Report for the Golden Age #2 Mining site were due on June 1, <br />2014. The submittal date for the Annual Fee and Report was extended to July 31, 2014. A review <br />of the Division's records found that the Annual Fee and Report have not been submitted. <br />On June 10, 2014, the Division mailed notice to you requiring a financial warranty increase in <br />the amount $1,800.00 to be submitted within 60 days of the date of notice. To date, the required <br />additional financial warranty has not been submitted to the Division. <br />Based on these findings the Division believes this is a violation of: <br />Rule 5.6 for failure to submit an annual report by the anniversary date of the Notice <br />of Intent to Prospect for each year following the filing of the NOI until a <br />reclamation responsibility release is granted. <br />C.R.S. 34- 32- 117(4)(c)(I1) and Rule 4.2.1(2) for failure to post additional financial <br />warranty within 60 days of the date of notice of adjustment. <br />Therefore, the Division has reason to believe that a violation exists to the Mined Land <br />Reclamation Act, C.R.S. 34 -32 -101 et sue., and have scheduled this matter to appear before the <br />Mined Land Reclamation Board. <br />A Formal Public Hearing will be held during the September 24 -25, 2014 Board Meeting for <br />consideration of this possible violation. The hearing will be held in Room 318 of 1313 Sherman <br />Street, Denver, Colorado, beginning at 9:00 a.m. on September 24 or as soon thereafter as the <br />matter can be considered.
