PERMIT#:M-1983-176 <br /> INSPECTOR'S INITIALS:TOD <br /> INSPECTION DATE:August 4,2014 <br /> INSPECTION TOPIC: Hydrologic Balance <br /> PROBLEM/POSSIBLE VIOLATION: Problem: Alluvial groundwater is mounding against the backfill <br /> material on the upgradient side of the site causing the neighbor's basement to flood. This is a problem for failure <br /> to minimize the disturbance to the prevailing hydrologic balance pursuant to C.R.S. 34-32.5116(4)(h) and for <br /> failure to protect areas outside of the affected land from slides or damages occurring during the mining operation <br /> pursuant to C.R.S. 34-32.5-116(4)(i). <br /> CORRECTIVE ACTIONS: <br /> 1. Relieve all flow restrictions and upgradient groundwater mounding by August 14, 2014. The Division <br /> will conduct an inspection on August 14, 2014 to verify compliance. <br /> 2. Submit to the Division a Technical Revision providing a revised groundwater mitigation plan by <br /> September 6, 2014. The revised plan shall include the following: <br /> a. A revised design for the temporary dewatering trench. The plan shall include a design to relieve <br /> groundwater mounding. <br /> b. Design depths for the temporary dewatering trench in each location provided on figure 1. <br /> c. Provide a monitoring and maintenance plan for the temporary dewatering trench. The Operator shall <br /> demonstrate to the Division that the trench is functioning properly by reporting the results of the <br /> monitoring and maintenance plan bi-monthly to the Division. <br /> d. Provide a construction schedule to complete the construction of the French Drain. <br /> Failure to meet the August 14, 2014 and/or September 6,2014 deadlines will result in enforcement actions. <br /> CORRECTIVE ACTION DUE DATES: August 14, 2014 Relieve all flow restriction and upgradient <br /> groundwater mounding, September 6, 2014 provide a Technical Revision including a revised groundwater <br /> mitigation plan. <br /> INSPECTION TOPIC: Revegetation <br /> PROBLEMIPOSSIBLE VIOLATION: Problem: There are state-listed noxious weeds present on site. This is a <br /> problem for failure to employ weed control methods for state listed noxious weed species within the permitted <br /> area, and to reduce the spread of weeds to nearby areas as required by Section 3.1.10(6) of the Rule. <br /> CORRECTIVE ACTIONS: Implement approved weed control plan and provide proof to the Division that this <br /> has been done. If a weed control plan is not already in place,the operator shall develop a weed control and <br /> management plan in accordance with Section 3.1.10(6) of the Rule. This plan should be developed in <br /> consultation with the county extension agency, or weed control district office and should include specific control <br /> measures to be applied, a schedule for when control measures will be applied and a post-treatment monitoring <br /> plan. This weed control plan shall be submitted to the Division as a Technical Revision to the approved plan with <br /> the appropriate Technical Revision fee of$216.00 by the corrective action date. <br /> CORRECTIVE ACTION DUE DATE: 9/01/2014 <br /> Page 2 of 9 <br />
