Therefore, exposure of ground <br />water must not occur during or after mining operations. <br />® The applicant has indicated plans to use water for the following purposes at the permit site: ❑ <br />evaporation, ® dust control, ❑ reclamation, ❑ water removed in the mined product, ❑ processing, <br />❑ other: <br />Applicant needs to document that this water was diverted in priority under a water right decreed <br />by the Water Court or well permit approved by the State Engineer for such industrial use at the <br />proposed place of use. <br />COMMENTS: The subject application is for a surface mining operation on 33.2 permitted acres located <br />approximately 8 miles northeast of Fort Morgan. The primary commodities to be mined at the site are <br />aggregate and gravel for construction purposes. The site is proposed to be reclaimed to its current use of <br />rangeland upon completion of this mining operation. <br />Excavation at the site will extend to a depth of approximately 20 feet, which is well above the estimated <br />depth to groundwater of 75 feet. Therefore, no groundwater is anticipated to be encountered at the site. <br />Water for dust control purposes is proposed to be hauled in from a well located on land owned by the applicant <br />in Section 11, Twp 4 North, Rng 57 West, 6th P.M. Based on a review of records available in this office, well <br />permit nos. 8580 -R -R and 8581 -R -R are the only wells located on the described property and are in the <br />applicant's name. The use of both wells is limited to the irrigation of 73.7 acres in the SE 1/4 of said Section 11. <br />Prior to initiation of use of ground water from well permit nos. 8580 -R -R and /or 8581 -R -R for dust control <br />purposes, the applicant will need to obtain a new well permit that allows for dust control use. A well <br />permit for such use could only be issued pursuant to an approved water supply plan or decreed plan for <br />augmentation. <br />If stormwater runoff is intercepted by this operation and is not diverted or captured in priority, it must be <br />released to the stream system within 72 hours; otherwise the operator will need to make replacements for <br />evaporation. <br />The applicant may contact the State Engineer's Office with any questions. <br />o <br />1313 Sherman Street, Room 821, Denver, CO 80203 P 303.866.3581 F 303.866.3585 www.water,state.co.us . <br />
