Compliance With Mine Plan <br />N - Support Facilities Not On -site <br />N - Other <br />N - Special Categories Of Mining <br />R - Processing Waste <br />N - Topsoil <br />COMMENTS <br />This was a partial coal inspection conducted by Jason Musick of the Colorado Division of Reclamation, Mining, <br />and Safety (Division) on 12 August 2014. The weather was clear and the mine site was dry during the on -the- <br />ground inspection. Scott Wanstedt of BME accompanied the inspection. <br />HYDROLOGIC BALANCE - Rule 4.05 <br />Drainage Control 4.05.1, 4.05.2, 4.053; Siltation Structures 4.05.5, 4.05.6; Discharge Structures 4.05.7, 4.05.10; <br />Diversions 4.05.4, Effluent Limits 4.05.2, Ground Water Monitoring 4.05.13; Surface Water Monitoring 4.05.13; <br />Drainage — Acid and Toxic Materials 4.05.8; Impoundments 4.05.6, 4.05.9; Stream Buffer Zones 4.05.18: <br />The DP -1 Pond was holding water at the time of the inspection. The pond embankments were stable and well <br />vegetated. The primary spillway is stable with no problems noted. The emergency spillway is stable with no <br />problems noted. <br />Pond PP -2 contained water with no discharge noted. Embankments were stable and well vegetated with no <br />problems noted. <br />Pond RP -2/3 contained a small amount of water in the upper cells with the lower cell dry at the time of the <br />inspection. The embankments were stable and well vegetated at the time of the inspection. <br />Pond RP -4 was dry. The pond embankments were stable. No problems were noted with the spillways at the time <br />of the inspection. <br />Pond RP -5a was dry. The combination primary /emergency spillway found to be incompliance with no problems <br />noted. The embankments were well vegetated and stable. <br />The D -Seam dewatering pond system was receiving water at the time of the inspection. Water was contained <br />within six cells associated with the system.
