Page 4 of 5 <br /> RE: Intent to File a Lien <br /> Good Afternoon Oliver, <br /> We received Opal's May Day Idaho Mine Complex"Intent to File a Lien"yesterday(8/8/2014)and suggest <br /> you reconsider your action. Wildcat Mining Corporation has been placed in a difficult position because the <br /> road is not built to DRMS/EPA approved design specifications and has not been formally accepted by the <br /> CDRMS. <br /> By the way,we just received the signed"as-built"drawing from Mountain Man yesterday. We submitted <br /> the as-built drawings in draft form because the final drawings were not made available. If we did not take <br /> the initiative to purse the drawings the as-built drawings would not have been presented to the DRMS. <br /> DRMS requires the drawings to be signed and stamped by a Colorado registered surveyor as a condition <br /> of approval. We expect a formal response from the Division in the near future. <br /> We have itemized our concerns(7/16/2014)and our position related to cost adjustments. We have also <br /> presented our potential regulatory exposure we may be facing going forward because of the deviations in <br /> implementing the approved design and contract. <br /> We received a notice from EPA/Army Corp(dated 8/4/2014)that they will be reviewing the project and <br /> assessing compliance with a draft consent agreement. This carries substantial penalties if they determine <br /> the road was not constructed in accordance with the draft consent agreement. This concern was presented <br /> in our itemized list presented to Opal on 8/7/2014. <br /> We will pay what we agree is owed within 30 to 60 days and is subject to resolving outstanding concerns <br /> related to the road as outlined in the contract. If you elect to continue on the path to file a lien on the <br /> property, the time to resolve this issue may take up to a couple of years to resolve and the process will cost <br /> both of us time and money. <br /> We will file counter claims in the event a lien is filed. Obviously payment will be withheld until this issue is <br /> resolved. Using the court is not desired and not an option of our choice. <br /> George M.L.
