Wildcat Mining Corporation has been placed in a <br /> difficult position because the road is not built to DRMS/EPA approved design specifications and has not <br /> been formally accepted by the CDRMS. <br /> Response No. 1 —The road was built to standards that exceed those shown on the approved DRMS/EPA <br /> design drawings. The road is wider, flatter, and the modifications that were made to the hydrologic controls <br /> to enable them to function are reported by your on-site assistant(Ray)to be working fine, including the <br /> retention basin. As you know,when construction initiated, the drawings and design were found to be flat- <br /> out erroneous. Opal's personnel worked through those problems to Wildcat's benefit, under Wildcat's <br /> oversight, direction and approval. <br /> There is no provision in Opal's contract to receive payment from Wildcat for the construction on the basis of <br /> any regulatory agency's acceptance or approval. We would never agree to that type of provision, <br /> particularly understanding that Wildcat has historic violations that have nothing to do with construction of <br /> the access road improvements. Using such an approval criterion as the basis for withholding an <br /> unreasonable portion of Opal's compensation is unacceptable. We are obligated under Colorado law to file <br /> a lien in a timely manner to secure payment to Opal and its various subcontractors and vendors. You left <br /> us no choice when you committed to immediately paying Opal$150,000 last week during the conference <br /> call and never lived up to that commitment. <br /> Comment No. 2-By the way, we just received the signed"as-built"drawing from Mountain Man <br /> yesterday. We submitted the as-built drawings in draft form because the final drawings were not made <br /> available. If we did not take the initiative to purse the drawings the as-built drawings would not have been <br /> presented to the DRMS. DRMS requires the drawings to be signed and stamped by a Colorado registered <br /> surveyor as a condition of approval. We expect a formal response from the Division in the near future. <br /> Response No. 2—As we have previously pointed out, Opal's use of Mountain Man as a surveyor was at <br /> Wildcat's insistence.
