Oct Total Twenty <br /> Year <br /> 35 133 174 199 166 89 59 615 7,752 <br /> To the extent that the subject Rural Ditch water rights from the four shares are not needed for <br /> immediate use, pursuant to paragraph 13 of the decree in case no. 2003CW306 the water may be <br /> stored in Dakolios Reservoir (WDID 0504003), 112 Reservoir (WDID 0504001), and their Von Ohlen <br /> Reservoir (WDID 0504002). Replacements for depletions under this plan will be made by releases of a <br /> portion of four shares in the Rural Ditch Company water previously stored in the 112 Reservoir, <br /> Dakolios Reservoirs and the Von Ohlen Reservoir under the decree in case no. 2003CW306. Excess <br /> consumptive use credits from the four shares of Rural Ditch stored in the 112 Reservoir, Dakolios <br /> Reservoirs and the Von Ohlen Reservoir will also be released to replace depletions for the VCI's Kurtz <br /> Pit, Heintzelman Pit and Bearson Pit. <br /> Hayseed Ditch (Case No. 90CWI74) <br /> VCI's 2 cfs interest in the Hayseed Ditch was changed in case no. 90CW174. The water available under <br /> the Hayseed Ditch will be used as an in stream credits to replace the non-irrigation season return flows of <br /> the Rural Ditch water changed in case no. 2003CW306. Use of the Hayseed Ditch under this SWSP is <br /> shown in Table I "Reservoir Operations Study, Dakolios East and West, 112 Reservoir& Van Ohlen <br /> Reservoir" <br /> Junior Storage <br /> Additional replacements for depletions during the non-irrigation season and during months with <br /> insufficient credits will be made by releases from water stored in VCI's Dakolios Reservoirs, 112 <br /> Reservoir, and Von Ohlen Reservoir. The water in storage is primarily junior water rights that were <br /> decreed in case no. 2001 CW274. <br /> Water was diverted through the Rural Ditch for storage in the 112 Reservoir and the Dakolios <br /> Reservoir over the extended free river period that started in September 2009 and continued through the <br /> beginning of June 2010. According to the decree in case no. 2001 CW274, water stored in the <br /> reservoirs or used directly at the point of diversion may be used for replacement of depletions at the <br /> mining sites owned or leased by VCI. The Durham Pit site and the Western Sugar Pit site have been <br /> identified as mining sites where the junior water rights decreed in case no. 2001 CW274 may be used <br /> as a source of replacement water. You indicated that as of January 1, 2013 the water stored in the <br /> reservoirs totaled 1,446 acre-feet consisting of a combination of Rural Ditch water and junior water <br /> decreed in case no. 2001 CW274. The attached Tables 1A and 1 B show the reservoirs operations study <br /> during the period of this SWSP. The average ground water contribution and direct and indirect <br /> precipitation for the two pits has been included in the study. The Applicant will use the junior water and <br /> the Rural Ditch water that had previously been stored in the 112 Reservoir, Dakolios, and Von Ohlen <br /> Reservoirs. Delivery of augmentation water to the Cache La Poudre River is subject to transit losses as <br /> determined by the water commissioner and the division engineer. <br /> The water rights decreed in case no. 2001 CW274 can be used directly at the points of diversion <br /> or retained in reservoirs for storage when the water rights are in priority or used by exchange for <br /> releases from any or all of the reservoirs or any or all of the direct flow sources. The decreed <br /> information for these junior water rights is shown in the following table: <br />
