BEFORE THE MINED LAND RECLAMATION BOARD <br /> STATE OF COLORADO <br /> FINDINGS OF FACT, CONCLUSIONS OF LAW, AND ORDER <br /> IN THE MATTER OF A THE APPLICATION FOR A 110(2) RECLAMATION <br /> PERMIT OF SHALE TECH INTERNATIONAL SERVICES, LLC, <br /> File No. M-2013-022 <br /> THIS MATTER came before the Mined Land Reclamation Board ("Board") on <br /> July 30, 2014 in Denver, Colorado as a consent agenda item to consider the 110(2) <br /> reclamation permit application filed by Shale Tech International Services, LLC <br /> ("Applicant"), file number M-2013-022. <br /> The Board, having considered the materials presented and being fully <br /> informed of the facts in the matter, enters the following: <br /> FINDINGS OF FACT <br /> 1. On April 4, 2013, the Division received a complete 110(2) permit <br /> application for the Duck Creek Mine, an oil shale operation ("Application"). The site <br /> is located at Section 24, Township 1 South, Range 100 West, 6th Principal Meridian <br /> in Rio Blanco County, Colorado, permit number M-1988-094. <br /> 2. On June 6, 2013, the Division of Reclamation, Mining and Safety <br /> ("Division") approved the Application following resolution of technical issues related <br /> to the Application content and set the financial warranty at $395,882.86. The <br /> Division notified the Applicant of its decision to approve the Application and sent <br /> the Applicant a letter and materials related to the posting the financial warranty. <br /> 3. On June 4, 2014, the Division received financial warranty and <br /> performance warranty for the permit. <br /> 4. On June 11, 2014, the Division sent an inadequate financial warranty <br /> notice to the Applicant. <br /> 5. On June 13, 2014, the Division received the corrected financial <br /> warranty in an approvable form. <br /> 6. On June 26, 2014, the Applicant published notice that the permit <br /> application would be reconsidered with a comment deadline of July 7, 2014. No <br /> comments were received prior to the comment deadline. <br /> 7. On July 8, 2014, the Applicant agreed to the Division's recommendation. <br />
