This permit is no longer valid under C.R.S. 37-90-137(11) and must be re-permitted in accordance with the actual operation. 3. The total surface area of the groundwater exposed at the Holcim Quarry site must not exceed 13.1 acres during the approval period of this SWSP resulting in an annual evaporative loss of 48.09 acre-feet. 4. The annual amount of water pumped from the Quarry Ponds (excluding the Duck Pond) and used in the mining operation shall not exceed 46.44 acre-feet for dust control. The Duck Pond will operate under its decree in Case No. 92CW35, which has a maximum amount of 55 acre-feet of water that can be pumped for operational purposes. 5. Total consumption at the Holcim Quarry site must not exceed the aforementioned amounts unless an amendment is made to this plan. 6. Approval of the use of the evaporation loss component of the changed Porter Ditch water right from Case No. 92CW35 will not make the Porter Ditch an alternate point of diversion to any other ponds located on the Holcim's DRMS permitted boundary and will not relieve the Applicant from the requirement to obtain a water court decree approved plan for augmentation to replace depletions to the stream system in time, place and amount. 7. Approval of this SWSP is for the purposes as stated herein. Any additional uses for which the water may be used must first be approved by this office. Any future additional historical consumptive use credit given (e.g. agricultural water transfer)for this site must consider all previous credits given. 8. The replacement water, which is the subject of this SWSP, cannot be sold or leased to any other entity. As a condition of subsequent renewals of this SWSP, the replacement water must be appurtenant to this site until a plan for augmentation is obtained. All replacement water must be concurrent with depletions in quantity, timing and locations. 9. The name, address and phone number of the contact person who will be responsible for the operation and accounting of this SWSP must be provided with the accounting form to the division engineer and water commissioner. 10. Accounting of water in this plan, including stream depletions and replacement water deliveries, must be provided to the Water Commissioner (Joshua.Kasper@state.co.us) and Division Engineer(Augmentation.Coo rdinatorestate.co.us) on forms and at times acceptable to them. Said accounting must be received by the 10th of the month following the month being reported. The name, address, and phone number of a contact person who will be responsible for the operation and accounting of this plan must be provided with the report. 11. All pumping for dust control shall be measured in a manner acceptable to the division engineer. Permanent records of all diversions must be maintained by the owner (recorded at least monthly) and submitted to the division engineer and water commissioner as required by the terms of this SWSP.
