<br />Peabody Sage Creek Mining, LLC, 36600 CR
<br />27, Hayden, CO 81639 0250, ( CDRMS Per
<br />mil No. 2009-087, approved June 8th,
<br />2010) is requesting release of Phase III bond
<br />liability on 1,028 acres of reclaimed :ands at
<br />the Peabody Sage Creek Mine (PSCM). A
<br />self bond in the amount of $4,420,284.46 is
<br />currently n place, a portion of which is being
<br />requested for release as determined by the
<br />Colorado Division of Reclamation, Mining
<br />and Safety ( CDRMS). Surface mining and in
<br />Itiai reclamation activities were performed
<br />under the Seneca Coal Company as part of
<br />the Seneca It Mine. A portion of these re
<br />claimed areas were removed from the Sen-
<br />eca II permit and transferred to the PSCM
<br />permit as a part of the mining permit ap-
<br />proval.
<br />The Phase II Bond Release Request is on re
<br />claimed areas that have received Phase II
<br />bond release and where reclaimed vegeta
<br />tion has met success criteria, the approved
<br />post mining lard use has been achieved,
<br />and hydrology assessments have been suc-
<br />cessful. The requested areas were ravage
<br />tated 1977 through 1995 in accordance with
<br />CDRMS rules and regulations.
<br />The Peabody Sage Creek Mine is located ap
<br />proximately nine (9) miles southeast of Hay
<br />den, Colorado. The specific area to which
<br />this bond release request applies Is included
<br />in portions of the following sections located
<br />within the permit area
<br />T6N R87 W:
<br />Section 35 - Portions of NESW, NWSW,
<br />SWSW, SESW, SWSE, SESE
<br />Section 36 Portions of SWSW, SESW, and
<br />SWSE
<br />T5N R87 W.

<br />SENW, SWSW, SESW
<br />Section 2 Portions of L1, L2, SWNE, SENE,
