July 28, 2014 C- 2010- 089/New Horizon North Mine MPB <br />ENFORCEMENT ACTIONS /COMPLIANCE <br />Notice of Violation CV- 2014 -004 was issued on June 26, 2014 for Failure to conduct all surface coal <br />mining and reclamation operations only as described in the approved application. Significant differences <br />were identified between as -built documentation for NHN- 00 lEast and West Ditches as compared to site <br />observations made during a complete inspection and combined OSM oversight inspection conducted on <br />June 3, 2014. The as -built documentation does not accurately replicate observed ground conditions <br />regarding the construction of the NHN -001 East and West Ditches. The Division has assessed the <br />proposed civil penalty and issued the Notice of Proposed Amount of Civil Penalty on July 17, 2014. <br />No enforcement actions were taken as a result of this inspection. <br />Number of Partial Inspection this Fiscal Year: 1 <br />Number of Complete Inspections this Fiscal Year: 0 <br />Page 3 of 4 <br />
