Cochran, John N. <br />From: Cochran, John N. <br />Sent: Thursday, May 15, 2014 09:42 <br />To: kelly.morgan @state.co.us <br />Cc: Katryna Snowden (ksnowden @peabodyenergy.com) <br />Subject: CDPS CO- 0048275 potential noncompliance issue <br />Kelly <br />I discovered yesterday afternoon after receiving the final laboratory report from ACZ Laboratories that a sample <br />collected at Outfall 004 on April 21, 2014 located at the Peabody Sage Creek Mine (CPDS Permit CO- 0048275) showed a <br />potentially dissolved selenium value greater than the effluent limit of 4.6 ug /L. The ACZ lab report shows a value of <br />potentially dissolved selenium at 9.1 ug /L. On the same day, another sample was collected at Site SSC6, which is located <br />at the lower end of the wetland established below Outfall 004, and the dissolved selenium for that sample reported by <br />ACZ Laboratories was 4.5 ug /L, which is lower than the selenium effluent limit for Outfall 004. <br />Conditions within the watershed above Pond 004 during the months prior to the April 21, 2014 sampling were <br />characterized by seasonal snowpack and subsequent springtime snowmelt runoff as in prior years, and may be <br />considered to be an upset conditions at this pond.. I will provide an explanation about this excursion when we report <br />the data in the upcoming quarterly DMR submittal for the 2nd quarter of 2014. Along with this email, PSCM considers <br />our brief conversation this morning to be our CPDS permit required 24 hour notification. The permit also requires that <br />we also submit within 5 days a written report.
