8.Division:
d the acreages
provided by BME. The Division currently has approved the amount of 464.86 disturbed
acreage and 8,095.46 affected acreage. Please provide an explanation to the discrepancies
between acreages specified by the Division and what BME has provided.

BME: The discrepancy concerning the Affected area originated from MR-156. An
increase of 1.56 acres was warranted due to a portion of the new roads falling outside of the
subsidence area. An increase of 7.22 acres was instead applied which included all proposed
disturbance. 5.66 acres of this disturbance was already accounted for in the Affected area
since it was Affected by planned subsidence.

The discrepancy concerning the Disturbed area was traced back to MR-145 and
MR-157, which was approved after MR-158, the base acreages used came back from MR-
reduction
156. Thus eliminating the 0 .52 acres of net disturbance associated with MR-158.
A total increase of 4.00 acres to the Divisions last Revised Decision (MR-157) document
total disturbed acreage is needed.

An additional 2.41 acres of disturbance was added to account for recently submitted
MR-159.

A revised page 3 of the renewal application form is attached with the proper
corrections made which reflects the appropriate account of the current acreage figures.

Page 4 was also updated to increase the estimated life of mine to 20 years.

Division
: The Division has reviewed all revisions that have been approved since the
previous renewal (RN-5). At the time of approval for RN-5, both the Divisions and BMEs
acreage tracking for disturbed and affected acreage for the Deserado Mine matched.
Reviewing each revision since RN-5, the Division has created three tables comparing
acreage changes requested by BME with each revision, acreage approved by the Division
and final adjusted acreage with corrected known errors. However, even with adjusting the
disturbed and affected acreages with the known errors, there still appears to be some
discrepancies between the Divisions calculated acreages and what has been provided by
BME with the renewal application. Please see the attached tables for reference.

Please provide additional explanation for discrepancies in disturbed and affected acreage for
the Deserado Mine in comparison to the Divisionrevised acreage calculations.

9.Division: Once the Division receives the response from BME regarding adequacy question
#8, an accurate updated reclamation cost estimate will be provided. As discussed with MR-
157, the removal of structures related to the B-Vent Shaft #2 will be removed from the

BME: Comments noted.
