No representative of New Elk Coal Company (NECC) was present. The weather was fine. Two <br />permitting actions are in progress and are detailed under the heading GENERAL MINE PLAN COMPLIANCE. <br />HYDROLOGIC BALANCE - Rule 4.05 <br />Drainage Control 4.05.1, 4.05.2, 4.05.3; Siltation Structures 4.05.5, 4.05.6; Discharge Structures 4.05.7, 4.05.10; <br />Diversions 4.05.4; Effluent Limits 4.05.2; Ground Water Monitoring 4.05.13; Surface Water Monitoring 4.05.13; <br />Drainage — Acid and Toxic Materials 4.05.8; Impoundments 4.05.6, 4.05.9; Stream Buffer Zones 4.05.18: <br />The two rows of straw bales were in position on the northern edge of the site. The small erosive area <br />protected by the bales appears to be under control, with signs of new vegetation filling in. <br />GENERAL MINE PLAN COMPLIANCE: <br />The following permitting actions are in progress: <br />• RN6. An application for Permit Renewal (RN6) was received on December 19, 2013. The Division found <br />the application complete on December 23, 2013. An initial adequacy review was sent to NECC on <br />February 21, 2014. The response from NECC was received by the Division on April 21, 2014. The <br />proposed decision due date has been extended to August 29, 2014. <br />• MR85. An application for a minor revision to update the vegetation sampling procedure, making it <br />suitable for a small area, was received on June 30, 2014, and approved on July 9, 2014. No comments <br />were received, so the decision became final on July 19, 2014. <br />REVEGETATION — Rule 4.15 <br />Vegetative Cover; Timing: <br />Vegetation sampling of the disturbed area and the reference area was scheduled for early July. <br />Number of Partial Inspection this Fiscal Year: 8 <br />Number of Complete Inspections this Fiscal Year: 4 <br />Page 2 of 4 <br />
