Vince Massarotti of New Elk Coal Company (NECC) was available during the inspection. <br />Mr Massarotti was working on several projects around the site with the assistance of Charley King. The weather <br />was fine although there was heavy rain shortly before the inspection. Permitting actions in progress are detailed <br />under the heading GENERAL MINE PLAN COMPLIANCE. <br />Since the last inspection Mr Massarotti had been given more autonomy in his role; he now reports directly <br />to Louis Head. Mr Massarotti continues to work closely with John Terry to ensure that time and materials are used <br />efficiently, that tasks are given the appropriate priority and that work on the ground is carried out in accordance <br />with the approved permit. <br />EXCESS SPOIL and DEVELOPMENT WASTE — Rule 4.09 <br />Placement; Drainage Control; Surface Stabilization: <br />A small dozer (D5) had been rented for a week and was being used to clean and shape the terraces on fills <br />7, 8 and 9. The vegetation on the fills was in keeping with the surrounding undisturbed areas. Woods Rose on fill 9 <br />was flowering. There were also some isolated thistles which appeared to be wavyleaf thistle Cirsium undulatum, a <br />native species. Since the thistle is not in a large patch and is not a noxious weed there is no current need for <br />treatment. <br />FISH and WILDLIFE — Rule 4.18: <br />A large herd of elk, maybe 40 head, was observed at pond 5. <br />HYDROLOGIC BALANCE - Rule 4.05 <br />Drainage Control 4.05.1, 4.05.2, 4.053; Siltation Structures 4.05.5, 4.05.6; Discharge Structures 4.05.7, 4.05.10; <br />Diversions 4.05.4; Effluent Limits 4.05.2; Ground Water Monitoring 4.05.13; Surface Water Monitoring 4.05.13; <br />Drainage — Acid and Toxic Materials 4.05.8; Impoundments 4.05.6, 4.05.9; Stream Buffer Zones 4.05.18: <br />Pond 9 had been cleaned of accumulated sediment - according to Mr. Massarotti, 141 truckloads of <br />Number of Partial Inspection this Fiscal Year: 8 <br />Number of Complete Inspections this Fiscal Year: 4 <br />Page 2 of 15 <br />
