OPERATORS <br />SHOULD READ THE FOLLOWING PAGES CAREFULLY IN ORDER TO ASSURE COMPLIANCE <br />WITH THE TERMS OF THE PERMIT AND APPLICABLE RULES AND REGULATIONS. If a <br />Possible Violation is indicated, you will be notified under separate cover as to when the Mined Land <br />Reclamation Board will consider possible enforcement action. <br />INSPECTION TOPIC: Backfilling & Grading <br />PROBLEM /POSSIBLE VIOLATION: Problem: The site is utilizing off -site fill without prior approval by the Division <br />per 3.1.5(9) of the Rule. <br />CORRECTIVE ACTIONS: The Operator shall provide a notarized affidavit, stating that the fill is, in fact, inert and <br />addressing all requirements pursuant to Rule 3.1.5(9), which describes the intended use of inert /off -site fill by <br />the corrective action date. The affidavit and requirements of Rule 3.1.5(9) must be submitted as a technical <br />revision to the Mine Plan in accordance with Rule 1.9. <br />CORRECTIVE ACTION DUE DATE: 8/21/14 <br />OBSERVATIONS <br />The Derr Pit was inspected by Peter Hays with the Division of Reclamation, Mining and Safety (Division /DRMS) <br />in response to a complaint notice received from Mr. Mark Goodwin with the United States Environmental <br />Protection Agency (EPA). Mr. Doug Derr with Broken Arrow Investments, LLC (Broken Arrow), Ms. Heather <br />Barbare with Weld County Department of Health and Environment, Ms. Diana Aungst with Weld County <br />Department of Planning Services and Mr. John Axelson, P.G. with the State of Colorado Oil and Gas <br />Conservation Commission were present during the inspection. <br />On May 19, 2014, the EPA received a complaint alleging Doug Derr, owner of the Derr Pit, was allowing oil and <br />gas companies to dump their left over bentonite and cement (drilling mud) at the Derr Pit. The Division was <br />notified of the complaint on July 10, 2014. The complaint stated the bentonite /cement mixture was a purplish <br />Page 1 of 3 <br />
