Box 639 <br /> Geyserville, CA 95441 <br /> Re: Grant of Right-of-Way and Pertni5sive Use of Limited Alternate Access <br /> Dear Mr. Howard: <br /> The law firm of Feldmann, Nagel & Associates, LLC, represents Rick Wyatt and Rod Wyatt <br /> (collectively the "Wyatts") in regards to the Grant of Right-of-Way found in Book 171 Page 498 <br /> and 499 of the Jackson County records. On May 12, 2009 you sent a letter to the Wyatts <br /> requesting the legal right-of-way be abandoned and an alternate access, which the Wyatts have <br /> allowed you and your lessee to use for several years, be granted to you as a legal right-of-way. <br /> On September 4, 2009 you sent a letter to the Wyatts requesting they reconsider their denial of <br /> your request to abandon the legal right-of-way and grant a right-of-way on such alternate access. <br /> In response to the above referenced letters, the Wyatts have no interest in the legal right-of-way <br /> being abandoned, or in granting you a legal right-of-way on the alternate access. As you stated <br /> in the above referenced letters, the Wyatts have given permission and allowed you and your <br /> lessee to use an alternate access for several years, however, the Wyatts have given no <br /> acquiescence in adverse use. The Wyatts maintain complete dominion over their property, and <br /> as such, will continue to allow you and your lessee to use the alternate access, for agricultural <br /> purposes only, and only until such tirne as the Wyatts mining operations reach the alternate <br /> access. Once the mining operations reach the alternate access, you and your lessee will no <br /> longer be allowed to use the alternate access, <br /> I <br />
