Stark <br />Environmental Protection Specialist <br />Division of Reclamation, Mining and Safety <br />1313 Sherman St., Room 215 <br />Denver, Colorado 80203 <br />�eGfa0.g%0tt. <br />p\V `sn� �� &safer! <br />Re: West Elk Mine (Permit No. C- 1980 -007), Technical Revision No. 134 (M -134), Revised Longwall Panel E6 <br />NOW Pad Locations (CHS #66144) <br />Dear Mr. Stark: <br />Thank you for your correspondence dated June 10, 2014 (received by our office on June 12, 2014) regarding the <br />subject undertaking. <br />Following our review of the documentation provided, we understand that the above - referenced technical <br />revision does not change the permitted, affected, or presently disturbed acreage within the West Elk Mine. As <br />such, it is our opinion that a finding of no historic properties affected is appropriate for this undertaking <br />pursuant to 36 CFR 8004(d)(1). <br />The Section 106 consultation process does involve other consulting parties such as local governments and <br />Tribes, which as stipulated in 36 CFR 800.3 are required to be notified of the undertaking. Additional <br />information provided by the local government, Tribes or other consulting parties may cause our office to re- <br />evaluate our comments and recommendations. Please note that our compliance letter does not end the 30 -day <br />review period provided to other consulting parties. <br />If previously unidentified archaeological resources are discovered in the course of the project, work must be <br />interrupted until the resources are properly evaluated in terms of the National Register of Historic Places <br />eligibility criteria (36 CFR 60.4) in consultation with our office. <br />Thank you for the opportunity to comment.
