PERMIT#: M-1989-052 <br /> INSPECTOR'S INITIALS: MAC <br /> INSPECTION DATE: June 25,2014 <br /> OBSERVATIONS <br /> The inspection was conducted by Michael Cunningham of the Division of Reclamation, Mining and Safety <br /> (Division). Rob Tibbets of Acme Brick Company was also present for the inspection. The Dakota Clay Pit is <br /> located 2 miles northwest of Golden, Colorado on the south side of W. 56th Ave. The site is permitted for 9.9 <br /> acres and the post-mining land use is rangeland. The commodity of interest is clay. <br /> The permit sign was posted at the site entrance and the boundary of the affected area was clearly delineated. <br /> The Dakota Clay Mine was not actively being mined at the time of the inspection. According to the most <br /> recent Annual Report, the Operator last conducted mining in April, 2013. However, the site is considered <br /> active since the Operator periodically removes material from the onsite stockpiles. The mine is located at the <br /> base of the hogback and the Operator removes the sandstone layers, which range between 2 -18 feet, in order <br /> to reach the clay layers. The sandstone is stockpiled on the north side of the mine bench. The Operator uses <br /> some of the sandstone in the manufacturing of brick products, the remaining sandstone stockpile will be <br /> backfilled along the toe of the ridge. To date the Operator has affected approximately 3 acres of the 9.9 acre <br /> permit area. <br /> The Division observed Scotch thistle with the permitted area. Scotch thistle is a Colorado List B noxious weed; <br /> List B species must be controlled to stop the further spread of these species. Construction Materials Rule <br /> 3.1.10(6) requires Operators to implement methods of weed control for all prohibited noxious weed species. A <br /> review of the permit file found the Operator does not have an approved weed control plan on file with the <br /> Division. The presence of noxious weed species is considered a problem and will require correction action; <br /> please see the first page of this report for additional information. <br /> The Division holds a financial warranty in the amount of$43,926.00. The financial warranty was last adjusted <br /> in 2009 and remains adequate to complete reclamation at the site. <br /> This concluded the inspection. <br /> Page 2 of 4 <br />
