Fontanero St. <br /> Colorado Springs, CO 80904 <br /> RE: Need for State Reclamation Permit <br /> Amazonite#1, 2, 3, 4, 5, 6, 8, 13, 14, and 15 Claims <br /> Dear Ms. Yerkey and Ms. Pehlman, <br /> Per our memorandum of understanding with the USFS, we have been informed of your USFS NOI <br /> Application for the above-mentioned claims. The Colorado Division of Reclamation, Mining and <br /> Safety (Division) has specific Rules and Regulations for Hard Rock, Metal, and Designated Mining <br /> Operations, adopted by the Colorado Mined Land Reclamation Board in July 1999. These rules are in <br /> accordance with the Colorado Mined Land Reclamation Act (Title 34 Article 32). It has come to the <br /> attention of the Division that you may be conducting mineral operations at your claims that requires <br /> a reclamation permit and/or a Notice of Intent (NOI) to conduct prospecting. <br /> As defined in the Act (34-32-103(8)), "mining operation" means the development or extraction of a <br /> mineral from its natural occurrences on affected land. These activities would need an approved <br /> Reclamation Permit with the Division. <br /> As defined in the Act (34-32-103(12), "prospecting" means the act of searching for or investigating a <br /> mineral deposit for the purpose of extracting samples prior to commencement of development or <br /> extraction operations (ie "mining operations"). Prospecting activities would need a Notice of Intent <br /> with the Division. <br /> An approved reclamation permit is required prior to conducting any mineral mining and/or an <br /> approved NOI is required prior to conducting prospecting activities on your claim.
