EXHIBIT D Mining Plan <br />a) The mining which has occurred in past years has exceeded the existing 110 permit <br />boundaries. The original pit area is being expanded to cover anything which occurred <br />outside the original boundaries. The operation has provided material for road <br />operations. The pit will continue to operate annually. The supply is undetermined, but <br />it is expected to last indefinitely because of the limited use of the pit. This should be <br />classified as an intermediate pit. <br />b) The pit boundaries are larger than the anticipated area to be mined. This will give the <br />county latitude in where stockpiles can be placed. <br />c) Excavation will continue as the need for clay continues for local road operations and, as <br />the supply remains available. Topsoil depths have varied between 4 -5" in depth. Any <br />topsoil stockpile will be seeded with brome grass to prevent soil erosion. There would <br />appear to be no waste rock or material at the site. <br />d) Mining is anticipated as deep as 20'. The mining began at the center of the pit and has <br />extended north and south. No slopes will be left greater than 3:1. <br />e) Access is available off County Road 49 and 8. A trail across the north side of Section 19 <br />will be used for direct access. The trail will not be improved, but simply used as it exists. <br />There will be no shop, plant, or other facilities located at the mine site. The equipment <br />used to mine the gravel will be a front -end loader, dozer, scraper, and trucks. There will <br />be limited stockpiling of material at the site. The anticipated stockpile areas are shown <br />on the mining plan. No processing of material is anticipated at the site. <br />f) All previous mining disturbance exist at the site. <br />g) There will be direct access from the pit onto county roads. No new roads will be <br />required. <br />h) No water is anticipated in conjunction with the operation. Groundwater is well below <br />the anticipated depth of mining. We will commit to keeping all mining efforts at least <br />two feet above and groundwater. There could be instances when heavy rainfall makes <br />the site too muddy to continue. At those times, mining will simply cease until the site <br />becomes dry enough to mine again. <br />i) Mining will not go into the groundwater at the site. <br />j) Since no water is to be used, there should be no injury to existing water rights. <br />k) No refuse, acid, or toxic producing materials are anticipated at the site. Other mining <br />enterprises in this part of Phillips County have never yielded any such materials. <br />Schneller Clay Pit Page 3 <br />
