July 14, 2014 <br /> 1,10: Kate Pickford, Durango Field Office <br /> v Virginia Brannon, Division Director <br /> Tony Waldron, Minerals Program Supervisor <br /> Russ Means, Grand Junction Field Office <br /> Division of Reclamation, Mining and Safety <br /> Department of Natural Resources,State of Colorado <br /> As Owners of Lot 1, Horseman's Park Subdivision, Hesperus, Colorado located at 800 Cross Creek Road, <br /> we submit our statement of concerns regarding the unpermitted mining operations by Luke the Duke <br /> LLC at 989 CR 120, Hesperus, Colorado together with the negative impacts to the neighborhood and <br /> surrounding properties. <br /> Horseman's Park is a three lot rural subdivision for single family dwellings linked through shared <br /> easements and permits for services. The adverse impacts of the mining operations conducted to date <br /> have directly and gravely impacted the properties and lives of the Owners of Lot 2 (Cliff and Carolyn <br /> Attkinson) and Lot 3 (Jeff and Claire Bradshaw) with noise, dust, traffic, and road impacts, and safety <br /> issues. In addition, the state of operations has and will continue to impact neighborhood property <br /> values. <br /> The Owner/operator, Luke the Duke LLC, submitted an application (Project 2012-0099) for a Class II <br /> Permit (includes public review and public hearings) in La Plata County. However, the proposed project <br /> did not proceed through the pre-application review with staff. Surrounding land owners have not been <br /> afforded the opportunity to participate in review and commentary regarding the inappropriate location, <br /> impacts, reclamation, and bonding for such operations in the midst of a residential neighborhood. <br /> We hereby seek your assistance to cease operations and to plan and implement a reclamation plan to <br /> return the land at the operations site to its original state. It is paramount that you work closely with the <br /> Owner/operator and monitor aggressively to ensure proper mitigation and consider your options/role to <br /> augment mitigation. <br /> Sincerely, <br /> T..,l o.
