Response: The current insurance certificate is included with the responses for replacement in Exhibit 1. <br />Rule 2.04.10 — Vegetation Information <br />1) The first sentence of the currently approved Page 2.04 -34 has been cut off on revised Page 2.04 -34. <br />Please submit a revised page with the first sentence at the top of the page. <br />Response: Page 2.04 -34 has been revised to include the missing text, and the revised page is included with <br />these responses. <br />Rule 2.04.11 — Fish and Wildlife Resource Information <br />1) The Division has received comments back from Colorado Parks and Wildlife in regards to MCM's <br />proposed TES listing. Colorado Parks and Wildlife finds that the list of species for Moffat County <br />is accurate except for one Candidate Species, the Greater Sage Grouse. Please add the Greater <br />Sage Grouse to the TES listing. <br />a. MCM Response: MCM has revised the listing and discussion of potential TES species to <br />include current information on the known occurrence and status of the Greater Sage <br />Grouse. The revised TES information accompanies these responses for replacement in the <br />PAP. <br />b. DRMS Response: The Division is required to forward updated TES information to the <br />Office of Surface Mining (OSM) to determine if a Section 7 consultation is required. The <br />Division has forwarded the revised pages in regards to this item to the OSM on May 13, <br />2014. The Division will notify MCM if any revisions to the information submitted are <br />required. <br />2) Please revise Page 2.04 -34 and 2.04 -40 to indicate additional threatened and Endangered Species <br />information can be found in Exhibit 15a. <br />3) With the submittal of TR36, a map was included that depicts the Greater Sage- Grouse and <br />Columbian Sharp- tailed Grouse active and inactive /historic leks. Also, a copy of an e-mail from <br />the Colorado Division of Parks and Wildlife was included. It is unclear if this information was to <br />be included in the permit document. It would be appropriate to add this information Exhibit 15a. <br />Please add these documents to Exhibit 15a with a brief introductory statement of the purpose of <br />this information. <br />Response: Pages 2.04 -34 and 2.04 -40 have been revised to reference Exhibit 15a, and the revised pages <br />are included with these responses. The referenced map and CPW e -mail are also included with these <br />responses for insertion in Exhibit 15a. <br />Rule 2.053 — Operation Plan — Permit Area <br />1) Under the revised "General Description of Exploration and Development Drilling Practices" <br />section contained on revised pages 2.05 -1 and 2, the applicant removed the seed -mix to be used for <br />the drill sites. Also removed from this section was a discussion about providing the Division proof <br />of compliance after abandoning drill holes and the list of information to be provided. Please add <br />this information back to this section. <br />2) Under the "Longwall Mining" section of revised page 2.05 -4, after the paragraph discussing the <br />development of the North Mains rock ramp to the "H" seam, there is a statement that appears to be <br />out of place. The statement indicates, "Although there are no present plans to mine in this area, <br />
