MCM reserves its options under existing "grandfathering ". Please clarify this statement and/or <br />otherwise revise this page as necessary. <br />3) Similarly, under the "Mining in Big Bottom" section; a statement indicates MCM reserves the <br />option under existing "grandfathered" rights to underground mine in this area. Please explain this <br />statement. <br />4) Revised Page 2.05 -16 indicates a number of roads will be left in place after reclamation to support <br />the post mining land use. The currently approved Map 29 clearly delineates which roads will <br />remain after reclamation. The revised Map 29 does not delineate which roads will remain after <br />reclamation. In accordance with Rule 4.03.l(1)(f) and 4.03.2(1)(g) requires that all haul and access <br />road be reclaimed unless they will be used in accordance with the post mine land use and the <br />landowner requests to the Division in writing that the road or certain parts be left in place for future <br />use. For each road intended to be left in place, please provide the Division with written approval <br />from the landowner(s) or commit to supplying this information prior to bond release. This <br />information should be added as a new exhibit to the permit and cited properly on the revised page. <br />Responses: Pages 2.05 -1 and 2.05 -2 have been revised to include the previously provided information on <br />seed -mix and proof of compliance. Page 2.05 -4 has been revised to clarify the statement on <br />" grandfathered" rights, and MCM's intent re: potential future mining. Page 2.05 -16 has been revised to <br />clarify approvals for postmining retention of roads, and reference both Maps 29 and 29a. All revised <br />materials are included with these responses. <br />Rule 2.05.4 -- Reclamation Plan <br />1) The Reclamation Map (Map 29) is proposed to be revised. The revised map does not include <br />pertinent information that is on the currently approved Map 29. For example, on portions of the <br />affected area, the map does not include; cross sections, adequate post mine contours, post mine <br />land use designations and dates of disturbance. Either add the currently approved information to <br />the revised map or keep the currently approved map and add the proposed revised map to the <br />permit under a different title and designation (Map 29a for example). <br />2) On the currently approved Reclamation Plan Map; Map 29 it is difficult to determine which areas <br />will be reclaimed to the following post mine land uses: Rangeland/Wildlife, Cropland and Pasture <br />Land. On the revised map discussed on the previous item, clearly delineate which portions of the <br />affected area will be reclaimed to the designated post mine land use. <br />3) Revised Page 2.05 -31.2 discusses reclamation of the Utah Tract. The currently approved narrative <br />for this section discusses the post -mine land use and seed mixture to be used for this area <br />(rangeland/wildlife) and discusses the mulching rate and crimping requirement. The proposed <br />revised page leaves out this information and simply indicates the MCM has applied for a Phase 1 <br />and 2 bond release for these parcels and plans to sample the areas for final Phase 3 bond release in <br />the future. Please revise this page to include the reclamation information. <br />Response: In order to provide all relevant information, MCM will retain the existing Reclamation Plan <br />Map, and add the updated Reclamation Map as Map 29a. As appropriate, text references have been <br />modified to reference both maps. Page 2.05 -31.2 has been revised to include the previously provided <br />information, and the revised page is included with these responses. <br />Rule 2.05.6 — Mitigation Of the Impacts of Mining Operations <br />
