Exhibit "D" Reclamation Plan <br />During operations the overburden will be placed to the side of the active dig site within the <br />assigned area boundaries so as to be easily pulled back into the hole that was excavated. All <br />excavated material will be kept within the permitted area. As each dig terminates, the hole will <br />be filled and reclaimed before we move to the next dig site. The grade of the mining areas vary <br />but most are very steep. 6.3.4(1) (b) states we must specify the slope of the reclamation which <br />could be as much as 1:1. Here it refers us to MINERAL RULES AND REGULATIONS OF <br />THE COLORADO MINED LAND RECLAMATION BOARD FOR THE EXTRACTION <br />OF CONSTRUCTION MATERIALS Rule 3.1 (7) "Maximum slopes and slope <br />combinations shall be compatible with the configuration of surrounding conditions and <br />selected land use." We will return the disturbed site to as close to the surrounding grade as <br />possible in compliance to this rule. <br />The excavator is used for both the digging and reclamation phases of the operation. The <br />filled holes will be smoothed to current contours and all evidence of our disturbance will be <br />mitigated as best possible. In addition to reclaiming our own hole we also reclaim any nearby <br />digs both recent and historical leaving the area better than when we started. <br />
