Canany <br />Acting Division Director <br />RE: DMG and SHPO Memorandum of Understanding <br />Addition of Categorical Exclusions <br />Dear Ms. Contiguglia: <br />It has come to our attention that the Division of Minerals and Geology (DMG), has been. <br />submitting permitting actions from our Coal Program that will not affect cultural resources and, <br />therefore, should not require review by the State Historic Preservation Officer (SHPO). To avoid <br />unnecessary review by your staff, the DMG is proposing the following categorical exclusions to <br />our May 1991 Memorandum of Understanding. <br />SHPO and DMG will consider the following actions to be categorical exclusions. For these <br />permitting actions, the SHPO will not be notified by the DMG. <br />1. Revisions whose area(s) are covered by previous consultations and that do not <br />request an increase to the surface disturbance area, unless those consultations took <br />place over five years ago, or were conducted to comply with a statute other than the <br />National Historic Preservation Act. <br />2. Permit renewals for those mines that have been fully reclaimed and those mines <br />where there will be no new disturbance. <br />If you concur with these exclusions, please sign on the line below.
