Final Reclamation Plait Permit No. M-1978-311 Technical Revision Application i <br /> The current plan and modifications based on current condition are outlined in Table 1-Final Reclamation <br /> Plan and Activities. <br /> Table 1-Final Reclamation Plan and Activities <br /> Reclamation Components Planned Reclamation Activities = <br /> Sealing of Portals -The mine portal has been provided with closures which preclude entrance to <br /> the mine. <br /> -The Department of Energy(DOE)prefers that this opening be left available <br /> for future use and have stated their preference to leave this structures at Final <br /> Reclamation. Gold Eagle Mining Inc. has submitted a letter to DOE <br /> requesting DOE to confirm their preference in writing(see attached). <br /> -Gold Eagle Mining Inc.is awaiting DOE's response and will transmit DOE's <br /> determination to DRMS once it has been received. <br /> Removal of Structures and Cleanup -The old steel ore bin and cribbing are of historical significance as supported <br /> by a 1994 BLM opinion. <br /> -The Department of Energy(DOE)prefers that these features remain in place <br /> at Final Reclamation. <br /> -Gold Eagle Mining Inc. has submitted a letter to DOE requesting DOE to <br /> confirm their preference in writing(see attached). <br /> -Gold Eagle Mining Inc. is awaiting DOE's response and will transmit DOE's <br /> determination to DRMS once it has been received <br /> Disposition of Waste -There is no mine waste at the site to be disposed or otherwise reclaimed <br /> Site Grading and Cokitourin -Contouring of the waste rock pile is complete. <br /> Weed Control -Noxious weed control has been successful at the Hawkcye Mine with annual <br /> application of spay by the operator. <br /> -The site will be monitored subsequent to final reclamation in order to <br /> determine the need for additional spaying of disturbances which may result <br /> from reclamation activities. <br /> Re-Vegetation -A site inspection will be conducted annually subsequent to reclamation in <br /> order to determine the need for additional planting. If planting is necessary <br /> the seed mix will be approved by the DRMS prior to planting. <br /> 4.0 Reclamation Schedule <br /> The DOE has stated in a letter dated October 26, 2011 that Judge William J. Martinez issued an opinion <br /> that the Defendants (bOE) "are hereby enjoined from approving any activity on lands governed by the <br /> ULMP, including exploration,drilling, mining and reclamation activities". In accordance with the Courts <br /> opinion Gold Eagle Mining Inc. is unable to initiate reclamation by October 1,2013 as indicated in the <br /> Divisions Inspection Report of May 16,2013. <br /> In addition and on February 27,2012,the Court amended the injunction to allow the agencies"to conduct <br /> only those activities on ULMP lands that are absolutely necessary". The amended injunction further <br /> addresses those emergencies as identified in Paragraph 5 (1)—that are"absolutely necessary to remediate <br /> dangers to the public�health,safety, and environment on ULMP lands caused by major storm events, acts <br /> of vandalism, or land subsidence". For this reason, we are requesting that DOE provide a letter stating <br /> that the reclamation Work is prohibited at this time since this work is not caused by any emergencies or is <br /> an imminent danger as defined by the amended injunction. <br /> Gold Eagle Mining Inc.
