Heifner <br /> 37 East Colorado Avenue Denver,Colorado 80210-3105 (303) 777-3371 <br /> June 26,2014 <br /> RECEIVED <br /> Tyler O'Donnell JUN 3 IJ 2014 <br /> Div of Reclamation,Mining,and Safety <br /> Room 215 DIVISION OF RECLAMATION <br /> 1313 Sherman Street MININGAND&V Y <br /> Denver,CO 80203 <br /> RE:Withdrawal of request for release of reclamation performed on a portion of Coal Creek Resource sand pit <br /> Permit: M-1988-044 <br /> Dear Mr. O'Donnell, <br /> Thank you for calling yesterday and discussing this matter and your suggested alteration in the process to complete <br /> the whole task of adjusting this permit to meet the new circumstances.As the first step in implementing your <br /> suggested approach,I request,in behalf of Schmidt Construction,the withdrawal of the request for release of the <br /> small parcel of reclaimed land referred to as the South Lowland in the existing permit.That request was submitted <br /> on June 5,2014. <br /> As you recommended,I will provide you with a new request for an acreage reduction that will include all currently <br /> permitted land outside of the new lease but also including the South Lowland reclamation area which is inside the <br /> new lease but in a separate portion. If the acreage reduction request is approved then the new permitted land will <br /> only include the remaining leased land in the northern portion of the property originally permitted,less any oil and <br /> gas development disturbances.That should result in a final permit area of about 740 to 760 acres. In the acreage <br /> reduction request I will check to make sure there aren't any additional oil and gas development disturbances that <br /> need to be removed,as was done back in June 2012. I am aware of some that are supposed to happen,but I will <br /> need to go to the site to get a current assessment of what is going on with further development.This request for <br /> acreage reduction should be provided to you(as well as the Land Board) next week. <br /> Following the acreage reduction,a technical revision will be submitted that will provide updated maps and any <br /> necessary adjustments to the mining and reclamation plan narratives that refer to actions on lands that will no longer <br /> be permitted.This way, full continuity in the permit is maintained as changes occur.
