MINREC is seeking approval to reconfigure the spillway of Pond <br />P -9 and reincorporate the refuse pond into the permit boundary, to allow for retention of <br />the mine water discharge for beneficial use by the land owner. I have the following <br />comments on the response. <br />1. MINREC has proposed an expansion to the currently approved permit boundary to <br />reincorporate the refuse area pond (permanent impoundment previously released from <br />our jurisdiction). MINREC needs to provide the following: <br />a) Documentation of an approved CDPS outfall at the refuse pond. <br />b) Verification that the pond is still constructed to the previously approved <br />design and that it continues to meet all of the requirements of Rules 4.05.7 <br />and 4.05. 9 (construction, capacity, spillways, water rights, etc.), in the form <br />of a certification under Rule 4.05.9(14)(b). <br />In addition, MINREC will need to conduct quarterly inspections and annual <br />certifications of the pond (Rules 4.05.9(15) and (17)) commencing with final <br />approval of TR -28. <br />Should you or the operator have any questions or need additional information, please let <br />me know. <br />1313 Sherman Street, Room 215, Denver, CO 80203 P 303.866.3567 F 303.832.8106 http: / /mining.state.co.us <br />John W.
