I have the following <br />comments on the application. <br />1. The design information provided for the single, open channel spillway is adequate as <br />submitted. The proposed spillway design is in compliance with the provisions of Rule <br />4.05.9, governing impoundments. <br />2. In this revision application, MINREC is proposing to relocate the Pond P -9 spillway <br />outfall to convey flows out of the currently approved permit boundary to the pond <br />formerly associated with the refuse disposal area (final bond release has been granted <br />on this previously permitted pond). The currently approved spillway system directs <br />flow out of the permit area to North Thompson Creek, under CDPS Permit C00048233. <br />The CDPS permit was issued when the Pond P9 spillways were in their current <br />configuration. <br />• Rule 4.05.2(1) requires discharge from underground workings to meet the <br />effluent limitations of Rule 4.05.2 before leaving the permit area. <br />• Rule 4.05.2(7) states that discharges of water shall be made in compliance with <br />the Colorado Water Quality Control Act and regulations promulgated pursuant <br />thereto, and with the effluent limitations promulgated by the United States <br />Environmental Protection Agency. <br />• Rule 2.03.10 requires the applicant to provide a list of all permits needed to <br />conduct the proposed mining activities. <br />1313 Sherman Street, Room 215, Denver, CO 80203 P 303.866.3567 F 303.832.8106 http: / /mining.state.co.us <br />John W.
