PERMIT#:M-1995-009 <br /> INSPECTOR'S INITIALS:ERR <br /> INSPECTION DATE:June 9,2014 <br /> OBSERVATIONS <br /> The inspection was conducted by Elliott Russell of the Division of Reclamation,Mining and Safety(Division).Mike <br /> Dorman of Dorman Brothers LLC was present for the inspection.The Fasse Pit is located approximately 7 miles east of <br /> Burlington,]Colorado.The site is an active I I2c operation with 36 acres permitted and the post-mining land use is <br /> pastureland.This inspection was carried out as a part of the Division's routine monitoring inspection program. <br /> At 13:45,the Division met Mr. Dorman at mine site along County Road V.At the time of the inspection it was cloudy and <br /> windy, and the ground was wet from a recent rain.The permit identification sign was not present at the entrance to the <br /> mine;this does not meet the requirements of Rule 3.1.12(l)and a sign will need to be posted,please see the corrective <br /> action section of this report for more information.The disturbance boundary of the mine was clearly delineated by a fence <br /> within the boundary of the actual permit.No mining activities were occurring during the time of the inspection,but there <br /> were two front-end loaders on site.There was also evidence of recent hauling of mined material observed. Some standing <br /> water was observed in the bottom of the pit,but is most likely as a result of the heavy rainfall the area received throughout <br /> the previous week. <br /> The site consisted of a highwall,approximately 45 feet at its highest point(average of 30 feet) and 1200 feet in length, <br /> along the eastern and southern portion of the pit.The highwall appeared to be stable and showed no signs of failure.There <br /> were three empty wash ponds in the northeastern portion of the pit and multiple topsoil piles around the perimeter of the <br /> pit; these were vegetated and marked by signs.The site also had three stockpiles of processed material in the northwestern <br /> corner and one additional pile in the bottom of the pit.The largest pile consisted of"fines"and was estimated at 15,000 <br /> C.Y.The Applicant stated that various contractors frequently take material from these stockpiles. <br /> A pair of 1 ge owls were observed nesting in the highwall at the time of the inspection. It was unclear if these were great <br /> horned owls or barn owls before they flew away. If the Applicant wishes to further mine this highwall or to start <br /> reclamation,the Division requests the Applicant take the conservation of Colorado's native wildlife and wildlife habitat <br /> into consideration; if the species are still present,waiting until after mid September to start the work on the highwall will <br /> allow any owlets to have fully fledged. Please contact the Division for more information regarding this situation. <br /> During the inspection,the Division observed a Downy Brome(Bromus tectorum) infestation on the mine site.Also <br /> known as cheat grass,this is a state listed noxious weed and will need to be treated.This will be cited as a problem in the <br /> inspection report,and will require corrective action. <br /> Mr.Dorman,who bought the land from Eugene Fasse and took over the mining permit from Fisher Sand and Gravel Co., <br /> asked about the pit location versus the actual size of the permit. He was interested in advancing the mine to the west,after <br /> all the stockpiled material was used, into areas with less overburden than what has already been mined.Using the <br /> boundary segments' bearings and lengths listed on the A-2 map of the amendment application(submitted 4/8/1998),the <br /> Division has made the attached map with the approximate permit boundary. Please note that this boundary line is <br /> approximate and the Division suggests that this boundary is surveyed and the corners delineated before advancing the <br /> mine. If the mine is advanced further than the fence which bounds the current mine disturbance,the Division will require <br /> the actual boundary markers to be established.Map A-2 is also attached. <br /> The Financtial Warranty was last calculated in 2002 and the Division currently holds$159,850.00.Following the <br /> inspection,I the reclamation cost estimate was updated with the current equipment costs and data as per Rule 4.2.1(2).The <br /> current Financial Warranty held is adequate to cover the actual cost to reclaim the site based on the new cost estimate. <br /> Photographs taken during the inspection are attached. <br /> Page 2 of 7 <br />
