A Quarry Lease Revised -2 <br /> sand, gravel and/or earth fill, and (3)the right to stockpile materials produced from such <br /> activities for future transportation. <br /> 4. Rent and Royalty Obligations. In consideration thereof, LESSEE shall have the <br /> following rent and royalty payment obligations under this Lease. <br /> a) LESSEE shall pay LESSOR under this lease one time base sum of seven-thousand <br /> dollars ($7,000.00)for the lease. <br /> b) LESSEE shall pay LESSOR a royalty of ten cents ($0.10) per crushed ton in addition <br /> to the one time base. <br /> c) LESSEE shall pay LESSOR the one time base and first royalty fee as set forth in <br /> 4(a)-(b) above within the calendar month immediately subsequent to the <br /> calendar month containing the first day of actual crushing and any additional <br /> royalties within the calendar month immediately subsequent to the month <br /> during which the crushing occurred. <br /> d) LESSEE shall process no more than 69,999 tons of crushed material as permitted <br /> per set. <br /> e) LESSEE shall stockpile for LESSOR 10,000 tons of crushed material per set. Said <br /> crushed material shall meet the same standard as used by the LESSEE for <br /> county streets and roads. . LESSEE anticipates crushing on site an average of <br /> three (3) out of every five (5) years but may crush on site more frequently as <br /> desired by LESSEE. <br /> f) In addition the LESSEE shall cause a gate to be placed at the haul road entrance. <br /> The gate will remain locked during times of idleness. <br /> g)The mining periods shall commence on the first day of actual mining and end one <br /> year thereafter. <br /> 5. Access Easement. As further consideration for LESSEE'S agreement to enter into this <br /> Lease, LESSOR hereby agrees that it shall and hereby does grant to LESSEE a fifty foot (50')wide <br /> access, ingress and egress easement over and across LESSOR'S-real property described in <br /> Exhibit "B" attached hereto and incorporated herein by this reference (the "Easement"),to and <br /> from the Premises, which Easement shall be for LESSEE'S use in connection with its production, <br /> transportation, and general operations on the Premises. Said easement shall be temporary and <br /> shall terminate without further action of either party upon termination of this Lease. Upon <br /> termination of this Lease, LESSEE shall leave the access as improved from time to time by the <br /> Lessee in place and any improvement on the access easement shall become the property of the <br /> LESSOR. <br /> 6. Requisite Permits; Conditions Precedent to LESSEE'S Obligations. LESSEE hereby <br /> agrees that, during the Term of this Lease and to the extent required for LESSEE'S mining <br /> operations described above, it shall be responsible for obtaining all County, State and Federal <br /> permits, licenses and approvals, and for the payment of all fees and bonds necessary for its <br /> operations. LESSOR and LESSEE each hereby understand, acknowledge and agree that LESSEE'S <br /> obligations under this Lease are expressly contingent upon: (1) LESSEE obtaining and <br /> maintaining during the term of the Lease a mining permit from the Division of Reclamation <br /> Mining & Safety, together with any and all other permits or approvals from any other Federal, <br />
