3.1.1 Establishing Post-Mining Use <br /> (1) The Operator/Applicant, in consultation with the Landowner, have decided to reclaim the <br /> affected area back to rangeland for a commercial cattle operation. <br /> (2) The results of the decisions were formulated into the reclamation plan. This application, of <br /> which this is a part, and all of the decisions formulated into it, constitute what the applicant <br /> believes is an appropriate and workable Reclamation Plan. <br /> 3.1.2 Reclaiming Substituted Land. <br /> Reclaiming substitute land is not a consideration of this operation. <br /> 3.1.3 Time Limit and Phased Reclamation <br /> The operator/applicant agrees that all reclamation shall be carried to completion with all <br /> reasonable diligence, and each phase shall be completed within five (5) years from the date <br /> the Operator/Applicant informs the Board or office that such phase has commenced. <br /> 3.1.4 Public Use <br /> The Operator/Applicant and Landowner do not propose the use of this land by the public. <br /> Mining will be done by an MSHA approved contractor and the public will not be allowed on <br /> site without a company representative, Part 46 of MSHA will be followed on this site. After the <br /> site has been released by the MINED LAND RECLAMATION BOARD, the Landowner may <br /> allow public access if it is deemed beneficial to the landowner. <br /> 3.1.5 Reclamation Measures - Material handling <br /> (1) Grading shall be carried on to create a final topography appropriate to the final land use <br /> selected in the Reclamation Plan. <br /> (2) Backfilling the excavated (mined) area will consist of overburden materials. Additionally all <br /> backfill material will be compacted in place to insure stability. No toxic or acid-forming <br /> materials will be on site nor will any be delivered to this mine site. <br />
