Susan Burgmaier -2- June 17, 2014 <br />2.' DRMS: The Division received comments from History Colorado, which were forwarded to <br />you on April 22, 2014. History Colorado stated that the proposed expansion of Pond D <br />and subsequent demolition of the King Mine Coal Sales building would have an adverse <br />effect on the National Register - eligible King Mine site. BRL has indicated that a mitigation <br />plan was approved in November of 1995, with the documentation provided in Volume VI <br />of the currently approved permit application package. The Division is currently working <br />with History Colorado to determine whether any additional action or information will be <br />required from BRL, and will notify you as soon as any determination has been made. <br />We have since discussed the proposal further with History Colorado. As a result <br />of those discussions, the Division will require BRL to complete Form 1403 and <br />forward the completed form to Joseph Saldibar at History Colorado (address below): <br />Along with the form, BRL should include an explanation that the proposed activities <br />are not a federal undertaking by referencing the State Permit (C- 1996 -083). It should <br />be noted that the proposed activities are a revision to state issued Permit No. C- <br />1996 -083. Please copy the Division on this submittal. <br />RL Grand River Institute will complete Form 1403 and it will be submitted as soon as it <br />is complete. <br />3. DRMS: BRL provided an abridged version, for review purposes only, of the revised <br />design information (SEDCAD output) for the Pond D watershed and indicated that the <br />complete design information would be submitted in a forthcoming revision that would <br />include plans to expand Gob Pile #2. The Division did not have access to and thus did <br />not review the entire Pond D watershed. Accordingly, when the remainder of the <br />watershed design is reviewed, there may be subsequent required changes to the portion <br />of the Pond D watershed design that was provided for our review. <br />BRL: Comment noted. <br />4. DRMS: The as -built design for the pond (currently Drawing 95266 -04 of Volume IV, <br />or a new Pond D Detail drawing labeled 22 -D), will need to be provided when the <br />construction is complete. A revised as -built drawing or, if the reconstruction is not <br />complete, a revised drawing of the proposed pond details will also be needed to review <br />the upcoming revision for the entire Pond D watershed. <br />BRL: Comment noted. <br />5. DRMS: BRL proposes the removal of Culvert C -F4 which will result in flow from Ditch D- <br />F21-2, that previously passed through Culvert C -F4 and over to Pond F, now being <br />directed to Ditch D -D3, Culvert C -G3, and Pond D. BRL did not provide updated <br />Structure Details for Ditch D -D3 or Culvert C -G3 to include the additional flow that would <br />enter Ditch D -D3 and Culvert C -G3.
