He said he was <br /> 'digging'a second pond (the first pond is to the north of my property adjacent to Cliff and Carolyns). That conversation <br /> was frustrating because Avery basically said'Don't worry, it'll increase your property value.The next week I saw a crusher <br /> being delivered and set up. I went over and asked Avery again what he was doing and why he did mention when we last <br /> spoke that there was to be a crusher set up? He said he was really busy and must have forgotten. He assured me <br /> everything was'legal'thru the Division of Mining.After a somewhat heated conversation he finally said he did not come to <br /> me or any other property owners because he did not want opposition. <br /> At that point I called Division of Mining &Reclamation.They said he did come in and fill out some paper work stating he <br /> was the owner/developer of this area and was doing this to'improve'roads'onsite'. <br /> That is not what he is doing. He recently sold the ranch and has been hired by those owners to build many ponds, roads, <br /> parking area,barns etc. and he is mining and crushing material, then selling it to them.That is a commercial operation <br /> and should be permitted thru a public review process,with re-clamation bonds,storm water,saftey etc. etc. <br /> Division of Reclamation&Mining agrees and have started an investigation.Their initial take is that he lied about his intent <br /> in order to avoid opposition. They unfortunately cannot stop him until the investigation is completed. If they determine he <br /> is in violation,they will fine him, make him get a permit and require a reclamation bond.After that the only recourse I have <br /> is civil. I will be having an appraiser out to my place as this is going to impact my land value dramatically. It has already <br /> impacted my quality of life here with the crushing now into it's third week.As well as the 1000 plus trucks that will need to <br /> be loaded and hauled off.And who knows how long he will take with the entire project. <br /> He will crush about 15,000 tons of gravel.Thats 1000 trucks at a minimum that will then have to be loaded &driven either <br /> down Equestrian Trail or thru my entrance(that I share with him)and down CR 120,then down Cross Creek. He will not <br /> say how long this is going to take place. His pond at the ranch took several years to haul off and complete. <br /> Avery is very upset and has placed the blue trailer he has used in the past to intimidate other neighbors at my entrance <br /> with the words I LOVE OBAMA AND MUSLIMS AND LAWYERS spray painted on it facing the road. He has spray painted <br /> my company name and switched the letters to read BJ CONSTRUCTION on the side. I am not only concerned with that <br /> type of mentality and escalation, but also for my daughters being subject to obvious intimidation&racism. <br /> I encourage you all to not only take a look, but if you feel this is wrong or impacting your property/roads,to please call La <br /> Plata County Code Enforcement as they are working with Divis of Mines. <br /> I will also keep you updated if you'd like,just let me know. <br />
