/JUN 1 1 2014 <br /> Divis'i of <br /> and Sa�`Y <br /> Claire Bradshaw<bradshaw.claire@me.com> June 11, 2314 12:35 RA <br /> 7b Lindsey Nicholson<nicholson@grn-law.com> <br /> Cc Jeff Bradshaw<bradshaw859@gmail.com>, "Carolyn S.Attkisson"<carolyn.attkisson@mac.com>, "Clifford <br /> Attkisson,Ph.D."`<cliffattkisson@mac.com> , <br /> Meeting with neighbor, Mr. Foutz <br /> Lindsey, <br /> This email is a formal communications regarding a face-to-face meeting Jeff and I had on June 10th with neighbor,Mr. <br /> Foutz. <br /> Mr. Foutz welcomed us into his home and we shared the facts to date regarding the illegal gravel mining being conducted <br /> on Avery's property next door to us.We shared that we have witnessed and recorded on video trucks being filled with top <br /> soil/overage from Avery's property and hauled and dumped onto Mr. Foutz's property.We clarified that that this was <br /> illegal and would require a commercial permit,which the Division of Mining has stated Avery does not have. <br /> Mr. Foutz responded that he"was not aware that Avery did not have a commercial permit; he was not aware of the <br /> magnitude of the mining going on;and he did not know it was illegal to have the top soil/overage hauled and dumped on <br /> his(Mr. Foutz's)property."We then urged Mr. Foutz to contact the Division of Mining himself to share this information. <br /> Mr. Foutz said he and his brother's"would be meeting with their legal council tomorrow(June 11,2014)to better <br /> understand what they can do." <br /> We then expressed again to him our concerns for our safety and our children's safety,given the offensive trailer <br /> placement by Avery and his continued mining given out requests for him to cease and desist in person and in writing by <br /> our attorney. Mr. Foutz then said, "After hearing about the trailer in our phone conversation, Claire, 1 asked Avery to move <br /> it."We thanked him for his help on this. <br /> He then went on to say that he was very"frustrated that no one put a stop to Avery at the county or state level,especially <br /> since Avery has no water rights,and therefore, no way of turning the land into a pond." <br /> We concluded the meeting with hand shakes and Mr. Foutz said"he would like to stay in touch and for us both to share <br /> information about next steps." <br /> Thanks, <br /> Claire <br /> Claire A.
