SECOND ADDENDUM TO AGREEMENT AGREEMENT ent ered into the day and year hereinafter set forth by and between THE LAMAR, COLORADO UTILITIES BOARD, a municipal corporation, d/b/a LAMAR LIGHT AND POWER, hereinafter referred to as "Lamar Light & Power" and ALL RITE PAVING&REDI-MIX, INC., hereinafter referred to as "All Rite", Recitals: Lamar Light & Power and All Rite entered into an Agreement dated November 13, 2012, and Said Agreement concerns a gravel pit operation known as the Sharp Gravel Pit, and All Rite has requested that this Agreement also apply to an additional gravel pit operation known as the Verhoeff Gravel Pit, and Lamar Light & Power is agreeable to such request upon the terms and conditions hereinafter set forth, NOW THEREFORE, in consideration of the mutual promises and covenants contained herein and other good and valuable consideration, the parties hereto agree as follows: 1. VERHOEFF PIT. Attached hereto consisting of three pages are aerial maps of'the proposed Verhoeff Gravel Pit. The parties agree that this additional gravel pit will be subject to the terms and conditions of the Agreement signed by the parties on November 13, 20112. 2. LEGAL DESCRIPTION OF VERHOEFF GRAVEL PIT. The legal description for the Verhoeff Gravel Pit is the E'/2, except the S'/ZS'/ZSE'/4, S'/ZN'/2SW'/4SE1/4, and S1/2NW'/4SE'/4SE'/4, of Section 34, Township 22 South, Range 50 West of the 611' P.M., Bent County, Colorado, consisting of 265 acres, more or less. 3. LEGAL DESCRIPTION OF SHARP GRAVEL PIT. The legal description for the Sharp Gravel Pit is the E'/Z of Section 35, Township 22 South, Range 50 West of the 6�'P.M., Bent County, Colorado, consisting of 320 acres, more or less. 4. MINING PLAN. Attached hereto consisting of three pages are maps showing the mining plan for the Verhoeff Gravel Pit. 5. BINDING EFFECT. This Agreement is binding upon the parties and their respective successors and assigns. 1
