This does not seem fair or just to us.The Division of Reclamation, Mining <br /> and Safety has the power to immediately impose a cease and desist order prior to a <br /> board hearing on this matter (Colo. Rev. Stat. 34-32.5-123: "Operating without a <br /> permit").We ask you to immediately impose a cease and desist order on Mr.Avery's <br /> activities. <br /> The mining and hauling must be stopped immediately until the legality and <br /> propriety of Mr.Avery's activities can be determined. There are many parties <br /> affected by his activities and all must now have their opportunity to comment and <br /> object. We ask you to put yourselves in our position.We must have an opportunity <br /> to be heard so that our voice and the public voice can have proper weight in the <br /> resolution of a deleterious situation that is having a significant impact on our lives, <br /> our property, and our quality of life. To delay is to make matters worse for us.What <br /> Mr.Avery will do, while undeterred, during the next month and a half will not easily, <br /> or ever, be undone.
