Frank Healy Page 2 <br /> June 17, 2014 <br /> You have enclosed the results of your analysis, which indicate that 95.8% of the depletions to the <br /> river pccur within the first month. Therefore you have made the assumption that all depletions may be <br /> considered to occur within the same month for accounting purposes. The total depletion to the Arkansas <br /> during the plan period of this SWSP is 95.36 acre-feet. <br /> Replacements <br /> A portion of the replacement water will be provided by Colorado Parks and Wildlife ("CPW")from <br /> their water portfolio with LAWMA. The agreement was attached with this SWSP submission. According <br /> to the contract, 47.68 acre-feet of fully consumable replacement water will be provided for the plan period <br /> from June 1, 2014 through May 31, 2015. <br /> The remaining 47.68 acre-feet of replacement water will be provided by excess accretions to the <br /> Arkansas River which results from the operation of Lamar's Rule 14 Plan and SWSP. The accretions are <br /> given in the attached Attachment 5, which is a projection of Lamar's depletions and accretions from June <br /> 2014 through May 2015. <br /> Conditions of Approval <br /> 1 This substitute water supply plan is hereby approved pursuant to Section 37-90-137(11), C.R.S., <br /> subject to the following conditions: <br /> 1. This SWSP shall be valid for the period of June 1, 2014 through May 31, 2015, unless otherwise <br /> revoked, modified, or superseded by decree. Should an additional SWSP be requested, such <br /> renewal request must be submitted to this office with the statutory fee of$257 per gravel pit at <br /> least 45 days prior to the expiration date of this plan. Once reclamation is complete and the <br /> release has been obtained from DRIVIS, the applicant must file an augmentation plan with <br /> the Division 2 water court, and submit the SWSP renewal under C.R.S. 37-90-308(4). <br /> 2�. No more than 30.2 acres (23.2 acres of post-1981 exposure) may be exposed at the Lamar East <br /> Pit during this plan year without first obtaining an amendment to the plan. <br /> 3. Subject to approval by the Division Engineer, the Applicant may lease or purchase additional <br /> replacement water from the sources approved in this plan. The Applicant must provide a copy of <br /> a lease/purchase agreement to the State Engineer's Office and the Division Engineer for use of <br /> such additional replacement water. Should any of the leases expire prior to the expiration of this <br /> plan, lease renewals must be obtained and submitted within 2 weeks of their expiration. <br /> 4. Approval of this SWSP is for the purposes stated herein. The State Engineer's Office must first <br /> approve any additional uses for which the water may be used. The replacement water, which is <br /> the subject of this SWSP, cannot be sold or leased to any other entity during the term of this <br /> SWSP without prior approval of the Division Engineer. <br /> �. The Applicant shall provide to the Division Engineer, within 30 days of the date of this approval, <br /> an electronic Excel spreadsheet showing, by WDID, the owner or contact person name, address <br /> and telephone number for each structure covered or used in this SWSP. The Applicant shall also <br /> provide to the Division Engineer an updated version of this spreadsheet if there are any owner or <br /> contact person changes within the approval period of this SWSP. <br /> �. The Applicant shall provide daily accounting (including, but not limited to diversions, depletions, <br /> replacement sources, and river calls) on a monthly basis. The accounting must be emailed to the <br /> Water Commissioner Joshua.Kasper(&state.co.us and to the Division Engineer(e-mail to <br /> Aug mentionCoordinator(cD-state.co.us), within 30 days of the end of the month for which the <br /> accounting applies.
