Box 33695 <br />Denver, CO 80233 -0695 <br />Re: New Horizon North Mine (Permit No. C- 2010 -089), TR -06, adequacy letter <br />Dear Mr. Gilbreath: <br />We received your submittal for TR -06 on May 9, 2014. There are some items to be addressed before the <br />Division can approve this revision. <br />1. This submittal indicates that the schedule for mining at New Horizon North will be delayed by <br />approximately two years. Please explain if this will or will not be an issue in the context of the <br />need for contemporaneous reclamation (Rule 4.13). <br />2. This submittal indicates that the post- mining topography will change. Please address this change <br />in other applicable parts of the Permit Application Package, including (but not necessarily limited <br />to) Map 2.05.4 -1 and Map 2.05.4 -2. Please explain if the change in topography impacts the <br />analysis of other ponds (e.g., Pond NHN 001). <br />3. In Section 2.05.3(4) it is unclear what has been changed. The cover letter says pages 1 — 6 but <br />only four of these pages were submitted. Please confirm that page 1 and page 5 had no changes. <br />In the Table of Contents, "Design Methodology" was deleted; is this an error? The format of <br />headings appears to be inconsistent; please correct this. <br />4. Appendix 2.053(4) -8 does not contain SEDCAD runs in the submittal. The table with ditch <br />design values in this appendix (Table 2.05.3(4) -8 -2) may contain errors, especially the flow <br />values. Please check these and explain why there are several values for the north ditch. If the <br />different values are correct, a map should be provided to show how sub - watershed SW2 -C is <br />further divided. <br />5. Appendix 2.05.3(4) -9 does not contain SEDCAD runs in the submittal. <br />6. In the monitoring table (Table 2 in Appendix 2.05.6(3) -3) SW -N212 can be listed as abandoned. <br />This was determined by the Division during a March 2014 inspection. We trust the judgment of <br />Tri -State in this matter. <br />7. The following observations regarding Map 2.05.3(4) -1 and Map 2.05.3(4) -9 need to be addressed <br />through explanation or revisions to the submittal. <br />a. PMT contour elevations are not provided, making the maps less informative. Please add <br />these or explain why the elevations are not labeled. <br />b. The arrow on Map 2.05.3(4) -1 implies a flow direction to the south rather than north to <br />the pond.
