Brown" <Sandy.Brown @state.co.us> <br />Spencer: <br />Fri, Jun 13, 2014 at 2:43 PM <br />During our inspection of the Carbon Junction Mine on June 4, 2014, most of our attention was focused on what <br />is termed the "Upper Carbon Junction Channel ", which extends upstream of the rip - rapped Permanent <br />Diversion Channel. 1 provide the following, on the understanding that your inquiry is related to the Upper <br />Carbon Junction Channel work that was completed in 2013. <br />When the Division issued NOV CV -2013 -005 to Oakridge Energy, Inc. ( Oakridge) on 23 May 2013, four separate <br />Abatement Steps were spelled out in the NOV. With Step #2, we required that Oakridge submit designs and <br />plans for: reestablishment of the Upper Carbon Junction Channel, including the un -named tributary, and for <br />reclamation and stabilization of the temporary diversion and gully erosion. Steps #3 and #4 required that the <br />work be accomplished in accordance with the plans developed under Step #2. <br />The application for TR -17 was submitted on 28 Aug and deemed Complete on 04 Sep 2013, which resulted in <br />Abatement of Step #2 (and #1, which is not discussed herein). Adequacy issues were addressed to the <br />Division's satisfaction, and we issued our proposed decision to approve TR -17 on 29 Oct. No comments were <br />received, and we formally Issued the revision on 12 Nov, at which point Oakridge's contractor commenced with <br />the repair and reconstruction work. Construction was completed on 18 Nov in accordance with the TR -17 <br />approved design; Steps #3 and #4 were abated on that date. <br />The new design approved with TR -17 replaced all previous designs for the Upper Carbon Junction Channel <br />(everything upstream of the rip - rapped Permanent Diversion channel). Goff Engineering and Surveying <br />developed the TR -17 plans, and these were incorporated as new "Exhibit 5 -12 ". Given Goff's unfamiliarity with <br />our Rules and other details of the Carbon Junction permit, changes made under TR -17 were limited to the <br />insertion of Exhibit 5 -12. [ Oakridge's regular permitting consultant was struggling with serious health issues <br />during most of 2013, and was unable to participate in the TR -17 process.] We are currently working with <br />Oakridge's regular consultant to update /revise the remainder of the permit to remove any information which <br />is contradictory to the material approved with TR -17.
