OPERATORS <br /> SHOULD READ THE FOLLOWING PAGES CAREFULLY IN ORDER TO ASSURE COMPLIANCE <br /> WITH THE TERMS OF THE PERMIT AND APPLICABLE RULES AND REGULATIONS. If a <br /> Possible Violation is indicated,you will be notified under separate cover as to when the Mined Land <br /> Reclamation Board will consider possible enforcement action. <br /> INSPECTION TOPIC: Backfilling & Grading <br /> PROBLEM/POSSIBLE VIOLATION: Problem: Failure to follow approved reclamation plan, or current reclamation <br /> plan needs to be updated and clarified pursuant to C.R.S. 34-32.5-116 (1). The operator must follow approved <br /> reclamation plan or provide sufficient information to describe or identify how the operator intends to conduct <br /> reclamation. The current mining configurations do not appear to be consistent with the final grading plan <br /> provided in the 1996 reclamation plan. In particular, the eastern highwall (phase 2) does not appear to have <br /> sufficient surface area or backfill material to achieve a 3h:1v final grade. <br /> CORRECTIVE ACTIONS: The operator shall submit a Technical Revision, with the required $216 revision fee,to <br /> update and clarify the current approved reclamation plan to reflect existing and proposed activities by the <br /> corrective action date. <br /> CORRECTIVE ACTION DUE DATE: 8/15/14 <br /> INSPECTION TOPIC: Gen. Compliance With Mine Plan <br /> PROBLEM/POSSIBLE VIOLATION: Problem:The current mine plan needs to be updated and clarified pursuant to <br /> C.R.S. 34-32.5-112 (1)(c)(VI). The operator must provide sufficient information to describe or identify how the <br /> operator intends to conduct the operation. The current 1996 mine plan on file with the Office states that <br /> "Reclamation will occur in conjunction with the mining operation...no more than five acres will be mined at any <br /> one time, a maximum of 10 acres of total disturbance (five acres of pit and the remainder being the detention <br /> pond, stockpile areas, and other miscellaneous disturbances) will occur at any time before reclamation <br /> commences." Based on air photos dated 10/6/2013 and the site inspection, the total area disturbed is <br /> Page 1 of 7 <br />
