PeabIR <br />GY <br />Peabody Sage Creek Mining, LLC <br />June 9, 2014 <br />Mr. Jason Musick <br />Division of Reclamation, Mining and Safety <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 -2273 <br />Peabody Sage Creels Mine <br />PO Box 250 <br />36600 Routt County Road 27 <br />Hayden, CO. 81639 <br />JUN 13 2014 <br />DIVISION OF RECLAMATION <br />MINING AND SAFETY <br />RE: Peabody Sage Creek Mine (Permit No. C- 2009 -087) — Minor Revision (MR25 -14) DRMS Abandoned Mine <br />Lands (AML) Protect <br />Dear Mr. Musick: <br />PSCM hereby requests a Minor Revision (MR23 -2013) to the approved Sage Creek Mine Permit (C- 2009 -087) for <br />notification of an AML project taking place partially within the existing permit boundary <br />Snow melt runoff and stormwater drainage across a pre -law surface mined area outside the permit boundary has cut down <br />through the topsoil and spoil resulting in the formation of a deep gully within an existing drainage channel. There is <br />potential for continued erosion and incision of the channel and continued filling with eroded coal and shale fines into a <br />downstream pond, thus decreasing the ponds depth and capacity as a storm water retention facility. The site was brought <br />to the attention of DRMS's AML program that has since planned to repair the site. <br />A temporary road will need to be built to access the damaged channel. A portion of the access road, the pond and a small <br />portion of the damaged channel exist within the PSCM permit area. AML has agreed that all disturbed areas within the <br />existing permit boundary will be restored, including seeding with the approved seed mix as specified in the mining permit. <br />The AML group will also monitor the site following construction activities to ensure slope stability, revegetation success, <br />and to control noxious weeds in following years until the site is fully reclaimed. <br />If you have any questions or need additional information please contact me via email at scowman(a)peabodyenerty.com <br />or by phone at (970) 276 -7003. <br />B.
