053; or (2) an application to convert the existing 110c permit to a 112c operation. <br />Once approved, the amended or converted permit must enclose all affected lands <br />and include an updated reclamation plan and financial warranty. <br />The Board imposes a CIVIL PENALTY for 48 days of violation at $1,000 per <br />day for a total civil penalty of $48,000. In addition, the Board imposes an additional <br />civil penalty for eight hours staff time in the amount of $453.12, for a total civil <br />penalty of $48,453.12. All but $500 of the civil penalty is suspended if the Operator <br />complies with the corrective action in the time specified. The portion of the civil <br />penalty not suspended, $500, shall be due and payable within thirty (30) days of the <br />effective date of this Order.
