BEFORE THE MINED LAND RECLAMATION BOARD <br />STATE OF COLORADO <br />FINDINGS OF FACT, CONCLUSIONS OF LAW, AND ORDER <br />IN THE MATTER OF THE REQUEST FOR EXTENSION OF THE DECISION <br />DATE BY LOCKLAND, LLC, Permit No. M -2013 -026 <br />THIS MATTER came before the Mined Land Reclamation Board ( "Board ") <br />on May 21, 2013 in Denver, Colorado as a consent agenda item to consider the <br />request for an extension of the decision date by Lockland, LLC ( "Applicant "), <br />permit number M- 2013 -026. <br />The Board, being fully informed of the facts in this matter, hereby enters <br />the following: <br />FINDINGS OF FACT <br />1. On May 2, 2013, the Operator submitted a new 110(2) permit <br />application for a proposed 9.9 -acre hard rock limited impact operation, located in <br />Section 20, Township 9 North, Range 79 South, 6th P.M., known as the Hopemore <br />Shaft ( "Application "). The Division of Reclamation, Mining and Safety ( "Division ") <br />deemed the Application complete for the purposes of filing on May 16, 2013. <br />2. The Division received a timely objection to the Application from the <br />U.S. Bureau of Land Management ( "BLM ") on May 24, 2013, stating that the <br />Applicant does not have a legal right of entry to initiate mining activities on the <br />affected lands. In accordance with the National Environmental Protection Act, the <br />BLM is required to prepare an Environmental Assessment ( "EA') for the <br />Applicant's proposed operation. The Applicant submitted a Plan of Operations to <br />the BLM in response to the objection and is working to address outstanding issues. <br />It is unlikely that the BLM will complete the EA within the 365 -day limit imposed <br />by Rule 1.4.1(9) of the Mineral Rules and Regulations of the Colorado Mined Land <br />Reclamation Board for Hard Rock, Metal, and Designated Mining Operations. <br />3. The Operator requests additional time, through July 31, 2014, to <br />address outstanding issues. The Division believes that such extension will allow <br />adequate time to address the current issues, for the BLM to complete the EA, and <br />for the Division to review any new materials submitted by the Applicant. The <br />Division recommends that the Board grant the request to extend the decision date. <br />
