PERMIT #: M- 1985 -210 <br />INSPECTOR'S INITIALS: MAC <br />INSPECTION DATE: May 29, 2014 <br />OBSERVATIONS <br />The inspection was conducted by Michael Cunningham of the Division of Reclamation, Mining and Safety <br />(Division). Doug Bachli of Rocky Road Investments was also present for the inspection. The Rocky Road Quarry <br />is located 4 miles west of Loveland in Larimer County, Colorado. The site is permitted for 106.5 acres with a <br />maximum allowed disturbance of 25 acres. The post- mining land use is rangeland. <br />The inspection was conducted as a follow -up to a complaint received from the Colorado Department of Public <br />Health and Environment (CDPHE) Incident Report System on March 14, 2014. The report was filed <br />anonymously and the complainant alleged that the Operator of the Rocky Road Quarry has dumped hundreds <br />of gallons of motor oil and hydraulic oil directly onto the ground surface over the past 8 to 10 years. In <br />addition, the complainant stated that the Operator has excavated the contaminated soil and disposed of it at <br />another location on the mine site. <br />During the inspection conducted on March 6, 2014, the Division observed staining of the soil in the equipment <br />service area which was indicative of minor spills of oil; however, there was no evidence that the Operator has <br />been deliberately dumping used motor oil and hydraulic oil onto the ground. The Division did not make any <br />observations which would indicate that any of the spilled oil had been mobilized from the equipment service <br />area. The Division required the Operator to submit a Technical Revision addressing sampling and removal of all <br />contaminated soil in the equipment service area. In addition, the Technical Revision was to provide a plan for <br />managing any future incidental spills in the equipment service area. <br />The Operator provided the results of the soil analysis on April 7, 2014. Soil sampling was conducted by <br />Palmetto Environmental Group and the laboratory analysis was performed by Pace Analytical Services, Inc. <br />The analytical results showed that all of the soil samples contained motor oil. In addition, various volatile <br />organic compounds (VOC) were detected in some of the soil samples; however, the levels of the VOC's did not <br />exceed Colorado Soil Evaluation Values. The Operator excavated approximately 60 cubic yards of <br />contaminated soil from the equipment service area. The contaminated soil has been stockpiled below the <br />equipment service area and is currently covered with tarps. The final requirement for clean -up includes the <br />appropriate off -site disposal of the contaminated soil. Following the disposal of the contaminated soil, the <br />Operator is to provide documentation to the Division demonstrating that the soil was disposed of in an <br />approved facility. <br />The Division received a Technical Revision from the Operator on May 12, 2014. The Technical Revision <br />provided a plan for containing incidental spills in the equipment service area. The Operator will construct a <br />concrete pad to service equipment on. Incidental spills on the concrete pad will be contained to the pad and <br />will be cleaned using absorbent materials. The Division approved the Technical Revision on June 10, 2014. <br />This concluded the inspection. <br />Page 2 of 3 <br />
