PERMIT #: M- 2000 -151 <br />INSPECTOR'S INITIALS: TCI <br />INSPECTION DATE: May 20, 2014 <br />Current Stipulations: <br />None. <br />Records: <br />• The previous inspection was conducted 6/10/2009. No problems were cited. <br />• The permit anniversary date is April 18. The Operator is current with annual fees and reports. <br />• The annual report indicates only 5 acres have been disturbed. Based on the extent of stockpiles in the <br />west portion of phase 1 circa 2005 (see Figure 1), the Division believes the disturbed area should be <br />considered closer to 10 acres. <br />• There have been no revisions for this permit, except the requested Temporary Cessation (TC). <br />• The pre- and post -mine land use is rangeland. <br />Bond: <br />The current financial warranty is a $64,540.00 corporate surety. The bond should be adequate for the estimated <br />10 acres of disturbance. However, before any additional area is mined (after coming out of TC), the bond <br />should be reviewed with the Division. <br />Summary and Recommendations: <br />1. The Division will recommend to the Mined Land Reclamation Board (MLRB) the site be approved for <br />Temporary Cessation (TC). The Operator will be notified of the Board's approval under separate cover. <br />2. The bond should be reviewed with the Division prior to any additional mining activity. <br />3. The highwall is raveling and even being undermined, which would not occur if the required 3:1 <br />perimeter excavation was followed at the perimeter. Failure to comply with the approved mine plan is <br />cited as a problem. The east highwall needs to be stabilized at 3:1 and backfilled to achieve the <br />required 25 -foot setback by September 30, 2014. Documentation of the completed repairs shall be <br />submitted to the Division by October 7, 2014. The Operator may consider revising the approved <br />mining and reclamation plans and Exhibit S, such that an alternative acceptable and stable configuration <br />can be demonstrated. If the Operator wants to request such revisions, a Technical Revision shall be <br />submitted by August 11, 2014. <br />4. As the Division does not have a noxious weed control plan on file for this site, a Technical Revision is <br />required to submit a Noxious Weed Control Plan and be must be received by August 11, 2014 <br />(including the required $216 fee). <br />Page 3 of 8 <br />
