Box 670 <br />Hayden, CO 81639 <br />June 6, 2014 <br />Re: Seneca II West SL5, Adequacy Review No. 2 <br />Dear Mr. Karo: <br />Seneca Coal Company (SCC) submitted an application for a Phase II bond Release for a <br />portion of the Seneca 11 West Mine on May 15, 2013. Once the Division determined the <br />application complete on July 18, 2013, the Division sent SCC a preliminary adequacy <br />review (PAR) on September 4, 2013, identifying items that needed additional information <br />from SCC. On April 3, 2014, SCC provided a response to the Division's September 4, <br />2013 PAR. <br />The Division has reviewed SCC's adequacy responses to the items identified in the <br />Division's September 4, 2013 PAR. This letter will follow the same numbering format as <br />the Division's PAR. Only items No. 9.a. and 9.b. require additional response from SCC. <br />1. The Division requested that a mesic dranage of Gulch 006 be removed from the <br />bond release application. Mesic drainage vegetative success needs to be <br />compared to pre- mining data of the Dry Creek drainage type. SCC had not <br />provided this comparison, and had not sampled the mesic drainage type as a <br />separate parcel. <br />SCC removed the mesic drainage of Gulch 006 from SL5 application. This parcel <br />was removed from associated maps and the requested bond release acreage <br />adjusted to remove this parcel. The response from SCC is acceptable. <br />2. At the time that SL5 was submitted, SL4 had not been approved. SL4 was approved on <br />December 19, 2013. Stocktank T -24, T -20, T -18, T -5 and upper reaches of PM 2 -D received <br />Phase I bond Release. SCC removed PM4 -D from the SL5 application. PM 4 -D has not received <br />Phase I bond release yet. Maps and acreage were updated to reflect the exclusion of PM4 -D from <br />the SL5 application.
