GRAVEL PURCHASE AGREEMENT <br /> Owner of Gravel Purchaser of Gravel and <br /> Permit Qperator <br /> Haynes Hereford Ranch Phillips County <br /> %Delbert Haynes District#2 <br /> 22975 County Rd 53 221 S.Interocean <br /> Holyoke,CO 80734 Holyoke,CO 80734 <br /> Haynes Hereford Ranch/ Delbert Haynes, owner of the gravel in the Haynes Hereford Ranch gravel pit <br /> located in the SW1/4 of Section 2, T7N, R45W of the 6th P.M., Phillips County, Colorado hereby agrees <br /> to sell gravel to Phillips County. <br /> Phillips County, as the purchaser, hereby agrees to obtain a mining permit from the State of Colorado and <br /> act as the operator of the pit. The plan for reclamation of the pit is hereby approved by the owner as this <br /> agreement is ratified. <br /> Gravel will only be taken from the areas described in the permit unless both the owner and Phillips County <br /> agree to extend the area to be mined. <br /> Research indicates that surface ownership of this land is held by Haynes Hereford Ranch and that the <br /> mineral rights are owned by Haynes Hereford Ranch. <br /> Haynes Hereford Ranch hereby certifies that payment should be made to them at the afore mentioned <br /> address. <br /> Claims for payment for gravel made by any other parties concerning this pit shall not be the responsibility of <br /> Phillips County. <br /> Phillips County agrees to pay .40 a yard for the gravel. Payment will be made to Haynes Hereford Ranch at <br /> the above address. This agreement is made for a period of 5 years and may be extended by mutual <br /> agreement or terminated with 60 days notice. <br /> The property owner,Haynes Hereford Ranch/Delbert Haynes, shall not be responsible for any of the gravel <br /> pit operations.
