To comments from the Corps of Engineers letter,this pit is not in an aquatic site and will not <br /> require the discharge of dredged or fill material. <br /> The final reclamation plan for the pit is to restore it to the current use of rangeland. This will <br /> include reclamation as recommended by MRCS. We assume that effort will satisfy the comments <br /> given by the Division of Colorado Parks and Wildlife. <br /> 6.4 SPECIFIC EXHIBIT REQUIREMENTS—REGULAR 112 OPERATIONS <br /> The following items must be addressed by the applicant in order to satisfy the requirements of C.R.S. 34- <br /> 32.5-101 et seq.and the Mineral Rules and Regulations of the Mined Land Reclamation Board: <br /> 6.4.3 Exhibit C-Pre-mining and Mining Plan Map(s)of Affected Lands <br /> 5.Rule 6.4.3(g)requires the Applicant to show the owner's name,type of structures, and location of all <br /> significant,valuable,and permanent man-made structures contained on the area of affected land and <br /> within two hundred(200)feet of the affected land.In the application on the Exhibit C-Site Map an <br /> overhead power line was labeled and drawn on the south side of County Road 11;also,what appears <br /> to be a fence was drawn on the west boundary of the pit.Please update this map by labeling the fence <br /> and providing the owner's name for the power line and fence. <br /> A map which shows the ownership of the fence and the power line is attached. <br /> 6.4.4 Exhibit D-Mining Plan <br /> 6.Please state the nature of the stratum immediately beneath the material to be mined as required by <br /> Rule 6.4.4(f)(i). <br /> The stratum immediately beneath the area to be mined is believed to be clay. <br /> 7. Please clarify the discrepancy of the mining plan's progression direction in Exhibit D-Mining Plan <br /> narratives"b)"and"d)",as well as the Mining Plan Map note"5)".Please update the narrative and/or <br /> the map, as necessary,with a consistent direction. <br /> Mining will begin at the southeast corner and proceed west and north as shown on Exhibit D- <br /> Mining Plan Map. A revised narrative page concerning that information for Exhibit D-Mining <br /> Plan is attached. <br /> 8. Please specify that topsoil will also be stripped at the proposed location of the overburden stockpile. <br /> Topsoil will be stripped and stockpiled to the north and east side within the north 150 feet identified <br /> on the Mining and Reclamation Maps. The narrative in the Mining Plan refers to said stockpiling <br /> in Exhibit D-Mining Plan(b): <br /> "The mining plan is to begin removal of the material beginning at the southeast side of the pit <br /> area. Mining will move south to north. Excavation will continue as the need for material <br /> continues and as the supply remains available. There is topsoil in the area that averages about <br /> 4"in depth. The pit will have the topsoil stripped and stockpiled for re-application durine <br /> reclamation. Any topsoil stockpile will be seeded with brome grass to prevent wind erosion. <br /> There also appears to be up to six feet of overburden. Overburden will be stockpiled to the <br /> north side of the pit and seeded to prevent wind erosion." <br />
